FRONTERAS DEL BIODERECHO Y LA BIOÉTICA

Resumen
Este artículo aborda las convergencias y divergencias entre bioética y bioderecho. La bioética y el bioderecho son discursos normativos que dan motivos de acción, cuya particularidad consiste en interactuar necesariamente con otras disciplinas y prácticas sociales en el momento de su elaboración y aplicación, y especialmente con las ciencias de la vida y tecnologías afines. Ambos términos se construyen con el prefijo bio, que apunta al campo común de aplicación de cada una de estas disciplinas normativas. Con el prefijo bio se incluyen en estos términos las ciencias de la vida, así como la investigación biomédica y clínica, sus aplicaciones tecnológicas y la práctica de la medicina a través de estas nuevas tecnologías. Se mostrará que la relación entre bioética y bioderecho es todavía un área por explorar, debido a las complejidades de su ámbito de aplicación, lo que invita a repensar la discusión tradicional sobre la relación entre ética y derecho.
